Official Rules for Pocketalk “Clear the List” Giveaway (“Official Rules”)

 

No purchase or donation necessary to enter or win. Making a purchase will not increase your chances of winning. 

By participating in the current Pocketalk “Clear the List” Giveaway (“Promotion”) promoted by Pocketalk via its official accounts on X (formerly Twitter), Facebook, Instagram, LinkedIn, or TikTok (collectively the “Pocketalk Accounts”), you agree to these Official Rules and represent that you satisfy all of the eligibility requirements in these Official Rules.

Please note that these Official Rules include a release of your rights and remedies. 

These Official Rules will refer to you as “you” or “Participant.”

PROMOTION DESCRIPTION: The Promotion begins on August, 9, 2024 and ends at 11:59:59 PM (CT) on August 22, 2024 (“Promotion Period”).

HOW TO ENTER: Details and additional requirements for entry or participation in the Promotion will be provided via the Pocketalk Accounts during the Promotion Period. Participants must follow the directions provided by the Pocketalk Accounts and these Official Rules to be eligible to receive a prize in connection with any Promotion. In the event of a discrepancy between the information provided via the Pocketalk Accounts and these Official Rules, these Official Rules shall prevail. Entry into the Promotion is free. Pocketalk reserves the right to disqualify any entry for non-compliance with these Official Rules or for tampering with the Promotion in any way. Entrants must be legal residents of the United States of America with a current U.S. address for prize fulfillment. Prizes that require shipment will not be shipped internationally. Entries generated by script, macro, robotic, programming or any other automated means are prohibited and will be disqualified.

You can also enter the Promotion by submitting a postcard that is no smaller than 3 ½ x 5 inches and no larger than 4 ¼ x 6 inches, addressed to “Pocketalk ‘Clear the List’ Giveaway”. You must legibly hand write on the postcard your full name, mailing address, phone number, and email address, and mail it with proper postage to the following address Pocketalk, 445 Sherman Avenue, Palo Alto, CA 94306. Such postcard must be received by Pocketalk within the Promotion Period and prior to the section of all Winners.

ELIGIBILITY: The Promotion is open only to legal residents of the fifty (50) United States and District of Columbia, who at the time of entry are (a) eighteen (18) years of age or older and (b) currently employed full- or part-time as an educator by an accredited public or private K-12 school in the United States (“Entrants”). Pocketalk is the official sponsor of the Promotion. Employees of Pocketalk and their affiliated companies, subsidiaries, distributors, sales representatives, agents, advertising and promotional agencies, and the immediate families and household members (parent, spouse, child or sibling) of each are not eligible to participate. The Promotion is subject to all applicable federal, state, and local laws and regulations.  Void where prohibited.

SELECTION AND NOTIFICATION OF WINNERS / PRIZES: Out of all Entrants, ten (10) will be randomly selected as winners (each a “Winner”).  Each Winner will receive the following (collectively, a “Prize”):  (a) to have their supply wish list fulfilled (up to $200); and (b) one (1) Pocketalk S device.  Winners will be selected at various times during the Promotion Period; all Winners will be selected by August 22, 2024 – or sooner at the discretion of Pocketalk.

APPROXIMATE RETAIL VALUE (ARV) / ODDS / TAXES: The ARV of the Prize is as follows:  Wish List:  $200 maximum; Pocketalk S device:  $249. Accordingly, the ARV of each Prize is a maximum of $449 and the total maximum ARV of all Prizes is $4490. Odds of winning depend on the total number of eligible entries received. Prizes unclaimed after sixty (60) days may not be awarded. Limit one (1) prize per person. All applicable federal, state, and local taxes with respect to a Prize are the sole responsibility of the Prize Winner.

PRIZE FULFILLMENT AND WINNER NOTIFICATION: All Prizes will be fulfilled by Pocketalk or a third party engaged by Pocketalk. Pocketalk or its representatives will contact Winners via social media direct message or email.

PUBLICITY. Except where prohibited by law, a Winner’s acceptance of the Prize constitutes permission for Pocketalk to use said Winner’s full name, social media handles, photographs, videos, likeness, statements, biographical information, voice, and city and state address for promotional or advertising purposes in connection with the Promotion on a worldwide basis, and in all forms of media, now or hereafter known, in perpetuity, without review, permission or further compensation, including without limitation on Pocketalk’s and its affiliates’ program(s), website(s) and social media page(s).

RELEASE: By entering the Promotion, Entrant releases Pocketalk, and any and all of its parent companies, subsidiaries, affiliates, and its and their directors, officers, employees, and agencies from any liability whatsoever, and waive any and all causes of action, related to any claims, costs, injuries, losses, or damages of any kind arising out of or in connection with the Promotion or delivery, misdelivery, acceptance, possession, use of or inability to use any Prize (including, without limitation, claims, costs, injuries, losses and damages related to personal injuries, death, damage to or destruction of property, rights of publicity or privacy, defamation or portrayal in a false light, whether intentional or unintentional), whether under a theory of contract, tort (including negligence), warranty or other theory.

GENERAL: Prizes are not redeemable for cash or transferable. No substitution of a Prize will be allowed except, at Pocketalk’s sole discretion, a prize of equal or greater value may be substituted. Only the number of Prizes stated in these Official Rules is available to be won. All Prizes will be awarded provided a sufficient number of eligible Entries is received. Any depiction of Prizes is for illustrative purposes only. All Prizes are awarded as-is and without warranty of any kind, express or implied. Pocketalk reserves the right to extend the submission deadline and/or Winner notification. Pocketalk reserves the right to modify, cancel, or suspend the Promotion or any part of it. If an Entrant is disqualified, or the Promotion is canceled or suspended, Pocketalk may, at its discretion, select potential Winner(s) in a random drawing from among all eligible, non-suspect entries received prior to the action taken. Pocketalk is not responsible for incorrect or inaccurate entry information whether caused by Internet users or by the equipment or programming associated with or utilized in the Promotion or by any technical or human error that may occur in the processing of the entries. Pocketalk is not responsible for computer system, phone line, hardware, software, or Promotion malfunctions or other errors, failures, or delays in computer transmissions or network connections that are human or technical in nature. Pocketalk retains the discretion to make all decisions regarding the interpretation and application of these Official Rules. All such decisions by Pocketalk are final. The laws of the State of California shall govern this Promotion. The courts of California shall be the exclusive forum for any dispute relating to these Official Rules and/or this Promotion. All Entrants and Winners agree, by their participation in the Promotion, to submit to the personal jurisdiction of the courts of California.

Please refer to Pocketalk’s Privacy Policy for important information regarding the collection, use and disclosure of personal information by Pocketalk.

NO THIRD PARTY ENDORSEMENT.  This Promotion is in no way sponsored, endorsed or administered by, or associated with Facebook, Instagram, LinkedIn, TikTok, or any other third party platform.
